Terms of Use

1. The agreement

By using any Noda website or product — including Noda Class, SnagMe, Nearby and Liuyao (together, the “Services”) — you agree to these terms. The Services are operated by the Noda team, Auckland, New Zealand ([email protected]).

2. Beta status

Some Services (for example SnagMe) are in public beta. During the beta, features are free of charge, may change without notice, and may be added or removed. We will try to give notice of material changes on the relevant site.

3. Information only — not professional advice

Valuations, deal scores and condition notes produced by the Services are automated statistical estimates generated from publicly available listing data. They may be wrong, incomplete or out of date.

They are not a registered valuation under the Valuers Act 1948, and they are not financial, legal or consumer advice. Before making any purchase decision, inspect the item yourself and obtain an independent mechanical or expert inspection.

4. Acceptable use

Use the Services lawfully and only through your own account. Do not attempt systematic scraping, bulk downloading, reverse engineering, or interference with the operation of the Services.

We may suspend or restrict accounts that abuse the Services or put their availability at risk.

5. Third-party content and trade marks

Listing details, prices and photos shown in the Services come from third-party marketplaces (such as Trade Me) and remain the property of their respective owners. They are displayed in limited form, for personal, non-commercial reference, with a link back to the original listing.

Trade Me is a trade mark of Trade Me Limited. The Services are independent tools and are not affiliated with, endorsed by or connected to Trade Me. Noda and product names are trade marks of the Noda team.

6. Consumer guarantees

If you acquire the Services for personal, domestic or household use and the Consumer Guarantees Act 1993 applies, you are entitled to guarantees that cannot be excluded. Nothing in these terms limits those rights.

Where the Act does not apply — for example while a Service is supplied free of charge in beta — the Services are provided “as is”.

7. Availability and liability

The Services are provided without a warranty of uninterrupted or error-free availability. To the maximum extent permitted by law — and never in a way that is unfair or misleading under the Fair Trading Act 2006 — we are not liable for any loss you suffer from relying on the Services, including purchase or sale decisions.

Nothing in these terms limits liability that cannot be limited by New Zealand law.

8. Changes

We may update these terms as the Services evolve. The current version is always published on this page; continuing to use the Services after a change takes effect means you accept it.

9. Governing law

These terms are governed by New Zealand law and the New Zealand courts have exclusive jurisdiction. If something goes wrong, contact us first — we will always try to resolve issues directly.
